Application data (account, notebook, messages) may be stored on cloud infrastructure inside the European Economic Area and/or outside it, depending on the technical provider. See the privacy policy.

3. Intellectual property

3.1 Ownership — all rights reserved

The publisher owns, or holds a licence to, the intellectual property in the Site and in the MyBrideBook service. All rights reserved. The absence of a notice, filing or symbol is not a waiver.

The following are reserved, and this list is not exhaustive:

  • the MyBrideBook name and mark;
  • the logo and monogram;
  • the visual identity, colours, typography and dressing of the Site;
  • the interface, its composition, journeys, screens and animations;
  • the text, including the notebook’s editorial text, titles and wording;
  • photographs and visuals of the Site and the notebook, except content the bride uploads and visuals a vendor still owns;
  • the structure, organisation and concept of the notebook, in their expression and arrangement;
  • the checklists, templates, methods and planning documents;
  • the selection, ordering and presentation of vendors, and the database that gathers them, its structure and its contents;
  • the source code, software architecture and technical documentation.

These elements are protected, as the law qualifies them, by copyright, trade mark law, database protection, unfair competition and parasitism, and by the terms of use. Protection of the vendor database covers the selection, structure and presentation made for MyBrideBook. It does not carry the rights a vendor keeps in her own name, mark or visuals.

3.2 What you may not do

Unless the publisher has given prior written permission, the following are forbidden, for all or part of the elements above, whether the use is free or paid:

  • copying, showing, adapting, translating, arranging, modifying or communicating them to the public;
  • imitating the Site, the notebook, its structure or its concept, including a close or slavish imitation, even with variations;
  • extracting or reusing, substantially or repeatedly, the contents of the database, including the selection and presentation of vendors;
  • scraping, harvesting, automated collection, or any systematic or bulk collection;
  • commercial reuse, resale, rental, transfer, sharing with a third party, or building them into another product or service;
  • creating, developing or running a competing service, notebook, app or guide from the content, structure, concept, code, templates or vendor database;
  • reverse engineering, decompiling, disassembling, or trying to reconstruct the source code, except where a mandatory law expressly allows it;
  • using them, directly or indirectly, to train, fine-tune, test or feed an artificial intelligence system, a model or a training dataset.

3.3 Licence to use

A purchase gives only a strictly personal, non-exclusive, non-assignable and non-transferable licence, limited to planning the wedding of the person who activated access, and to the period set in the terms of use. The licence transfers no intellectual property, no right to sublicense, and no right to share the account.

3.4 Remedies

A breach may lead, without limiting any other right, to:

  • a formal notice to stop;
  • removal or delisting of the disputed content;
  • suspension or ending of access;
  • damages for the whole loss;
  • payment of the lawyers’, bailiffs’, experts’ and court costs spent to record and stop the breach;
  • any urgent measure before the competent court, including an injunction or an equivalent procedure.

The publisher reserves every right and claim, including for infringement, unfair competition and parasitism, and without prejudice to any criminal provision that may apply. These rights survive the end of access.

4. Governing law and courts

The publisher is established in Israel. This notice and use of the Site are governed by Israeli law.

Unless a mandatory rule gives a consumer another court, any dispute about the Site or the service belongs to the courts of Jerusalem.
